1. Acceptance of Terms

Welcome to Kreomnis. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kreomnis ("Company," "we," "us," or "our") governing your access to and use of our family organization platform, including any related websites, mobile applications, and services (collectively, the "Service").

These Terms incorporate by reference our Privacy Policy and Cookie Policy.

2. Description of Service

Kreomnis is a comprehensive family organization platform that enables households to:

• Manage tasks and to-do lists collaboratively
• Plan and share family calendars and events
• Create meal plans and shopping lists
• Track household budgets and expenses
• Monitor children's activities, homework, and routines
• Manage household inventory
• Access AI-powered assistance for family organization (PRO tiers)
• Integrate with third-party services like Google Calendar (PRO tiers)

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice when possible.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You may register using your email address or through third-party authentication providers (e.g., Google OAuth). You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information as necessary
• Keep your password secure and confidential
• Be at least 18 years old, or have the consent of a parent/guardian if under 18
• Not create accounts for others without their permission

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorized access or security breach
• Not share your account credentials with others
• Not use another user's account without their express permission
• Log out from shared or public devices

3.3 Account Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms or any applicable laws
• You engage in fraudulent, abusive, or malicious activity
• You fail to pay applicable fees
• Our security systems detect suspicious activity from your account
• We are required to do so by law

We will provide notice before suspension when reasonably possible, except in cases of fraud or security threats.

4. Subscription and Payments

4.1 Service Tiers

Kreomnis offers multiple subscription tiers:

• Free Tier: Basic features with limitations on storage and household size
• Starter: Enhanced features for small families
• Pro: Full features including AI assistance and integrations
• Family: Premium features for larger households with priority support

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing to a paid tier, you authorize us (through our payment processor, Stripe) to charge your payment method for the applicable fees.

• All prices are displayed in EUR and include applicable taxes
• Subscriptions automatically renew unless cancelled before the renewal date
• We will notify you of any price changes at least 30 days in advance
• Failed payments may result in service interruption or downgrade to Free tier

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• Your account will be downgraded to the Free tier
• Data exceeding Free tier limits will be preserved for 90 days, then deleted
• You can reactivate your subscription at any time

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by Kreomnis and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without written consent
• Reverse engineer, decompile, or attempt to extract the source code
• Remove any copyright or proprietary notices

5.2 Your Content

You retain ownership of all content you create or upload to the Service ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store, process, and display your User Content to provide the Service
• Share your User Content with other members of your household
• Create backups for data protection purposes
• Use anonymized, aggregated data for service improvement and analytics

This license terminates when you delete your User Content or close your account, except for data we are required to retain for legal purposes.

6. User Content and Conduct

6.1 Your Responsibilities

You are solely responsible for your User Content and activities on the Service. You represent and warrant that:

• You own or have the right to use all content you submit
• Your content does not infringe any third-party intellectual property rights
• Your content does not contain any confidential information of third parties
• You have obtained consent from any individuals whose personal data you include

6.2 Prohibited Activities

Violations may result in immediate account termination and potential legal action. Our security systems automatically detect and block malicious activity.

7. Households and Sharing

Kreomnis allows you to create and manage households with other users:

• Household Creation: Account holders can create households and invite members
• Member Roles: Owners can assign roles (Admin, Member) with different permissions
• Data Sharing: Content within a household is visible to all members with appropriate permissions
• Leaving Households: Members can leave households at any time; their personal data will be removed from the household

You are responsible for the members you invite to your household. Only invite people you trust with access to shared family information.

8. Third-Party Services

The Service may integrate with or contain links to third-party services:

• Google OAuth & Calendar: For authentication and calendar synchronization
• Stripe: For payment processing
• AI Services: For AI-powered features (PRO tiers)

These third-party services have their own terms and privacy policies. We are not responsible for their practices or content. Use of these integrations is at your own discretion and risk.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That the results obtained from the Service will be accurate or reliable
• That any errors in the Service will be corrected

We do not warrant that the Service is free of viruses or other harmful components. You assume all responsibility for adequate protection and backup of your data.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kreomnis, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by:

• Going to Settings → Account → Delete Account
• Contacting us at contact@kreomnis.com

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We detect fraudulent or malicious activity
• Your account has been inactive for more than 24 months (Free tier)

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data in accordance with our Privacy Policy
• Sections 5, 9, 10, 11, 13, and 14 of these Terms survive termination

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

For EU consumers: You may also benefit from any mandatory provisions of the consumer protection laws in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at contact@kreomnis.com to attempt to resolve the dispute informally. We will work in good faith to resolve your concerns within 30 days.

14.2 EU Online Dispute Resolution

If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

14.3 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of a class, collective, or representative action.

15. Changes to Terms

We may modify these Terms at any time. When we make material changes:

• We will update the "Last updated" date at the top of this page
• We will notify you via email at least 30 days before changes take effect
• We may display a prominent notice within the Service
• Continued use after the effective date constitutes acceptance

If you do not agree to the modified Terms, you must stop using the Service and may request account deletion.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kreomnis regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labor disputes, or government actions.
